SMH: Child Molester Sentenced to 300 Years Gets Freed On Technicality 

It's a shame that a guilty child molester could ever get freed. 

A Colorado man sentenced to more than 300 years in prison for sexually molesting six children has now been freed on a technicality.

 

Michael McFadden was sentenced in 2015 to serve more than three centuries behind bars after being convicted of 19 counts of sexual offenses against children, KJCT reports.

 

McFadden, 46, was released from prison on Tuesday after the Colorado Court of Appeals overturned his conviction.

 

He cannot be retried on those charges.

 

"I am completely appalled at this decision," Mesa County District Attorney Dan Rubinstein told the outlet, "I think the criminal justice system completely failed here."

 

Many parents of McFadden's victims are devastated over the decision, with their children now living in fear, KREX reports.

 

The court overturned McFadden's conviction because they determined his right to a speedy trial was violated, reports say.This all has to do with a jury questionnaire from before the trial itself even started.

 

While preparing for jury selection, the defense team submitted a questionnaire that addressed McFadden's prior illegal sexual conduct and whether jurors could be fair to him while considering those prior cases, KJCT reports.

 

Rubinstein says the judge did not even look at the questionnaire until halfway through jury selection.

 

When he finally did see it, he realized jurors should not have been given details of the prior cases yet, and as a result McFadden could not get a fair trial.
