Things may be turning around for the controversial 49ers linebacker Aldon Smith. ESPN reports that the LA County District Attorney's office has referred Smith's case to the LA City Attorney's office for misdemeanor consideration, meaning the 49ers start will NOT be charged with a felony.

Smith was arrested on April 13th at Los Angeles International Airport for lying to and telling TSA officials that he had a bomb on him. Now all that Aldon needs to worry about now is his court appearance for felony gun charges and a DWI.
